Terms & Conditions

The terms governing your access to and use of the TalksTry messaging application and related services.

1. Acceptance of Terms

These Terms & Conditions ("Terms") form a binding agreement between you and [COMPANY LEGAL NAME] ("TalksTry," "we," "our," or "us"). By downloading, installing, registering for, or using TalksTry (the "Service"), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility & Age

You must be at least 13 years old (or the higher minimum age required in your jurisdiction). If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian. By using the Service you represent that you meet these requirements and can legally enter into these Terms.

3. Accounts & Registration

You can register using a mobile number with OTP verification or an email address and password. You agree to provide accurate information and keep it current. You are responsible for all activity under your account and for keeping your password, verification codes, and any two-step verification PIN confidential. Notify us promptly of any unauthorized use.

4. License to Use TalksTry

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use TalksTry for your personal, non-commercial communication. You may not copy, modify, distribute, sell, lease, reverse-engineer, or extract the source code of the Service except where such restriction is prohibited by law.

5. Acceptable Use

You agree not to use TalksTry to:

• Violate any law or the rights of others.
• Send spam, bulk unsolicited messages, or engage in phishing or fraud.
• Harass, threaten, abuse, defame, or impersonate any person.
• Distribute malware or attempt to disrupt or gain unauthorized access to the Service.
• Share content that is illegal, sexually exploitative of minors, hateful, or that incites violence.
• Infringe intellectual property or privacy rights.
• Collect or harvest other users' data without authorization.
• Use automated means to access the Service except as expressly permitted.

We may investigate suspected violations and take action, including removing content and suspending or terminating accounts.

6. Objectionable Content & Abuse (Zero Tolerance, Reporting & Blocking)

TalksTry maintains a zero-tolerance policy toward objectionable content and abusive users. Objectionable content includes, without limitation, content that is illegal, sexually explicit or exploitative (especially any content involving minors), hateful, harassing, threatening, defamatory, violent, or otherwise offensive. Abusive behavior includes harassment, threats, impersonation, doxxing, or repeated unwanted contact toward other users.

By using the Service, you agree that you will not create, upload, send, or share any objectionable content and that you will not behave abusively toward any other user. Acceptance of this policy is a condition of using the Service.

Reporting. You can report objectionable content or an abusive user directly from within the app. Reports are sent to our moderation team for review.

Blocking. You can block any user at any time. Blocking immediately removes that user's content from your view and prevents them from contacting you further. Blocking a user does not, by itself, submit a report — use the report option if you want us to review the conduct.

Our action. We review every report and will remove objectionable content and eject the user responsible within 24 hours of becoming aware of it. We may take this action at our sole discretion and without prior notice. Repeat or severe violations may result in permanent removal from the Service.

7. Your Content

You retain ownership of the messages, media, and files you send ("Your Content") and are solely responsible for them. You grant us only the limited rights necessary to operate the Service — such as transmitting, temporarily storing, and displaying Your Content to your intended recipients. We do not claim ownership of Your Content and do not use it for advertising.

8. Privacy

Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described there.

9. Third-Party Services & App Stores

The Service relies on third-party providers (such as cloud hosting, push notification, and crash-reporting services) and is distributed through the Apple App Store and Google Play. Your use of those platforms is also subject to their terms. Where required, the applicable app store is a third-party beneficiary of these Terms and may enforce them. Links shared in chats may lead to third-party websites we do not control or endorse.

10. Intellectual Property

The TalksTry app, name, logo, and all associated software, designs, and content (excluding Your Content) are owned by [COMPANY LEGAL NAME] or its licensors and are protected by intellectual property laws. Except for the limited license granted above, no rights are transferred to you.

11. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that messages will always be delivered without delay.

12. Limitation of Liability

To the maximum extent permitted by law, [COMPANY LEGAL NAME] and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of or inability to use the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD 50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless [COMPANY LEGAL NAME], its affiliates, and personnel from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, or your violation of these Terms or applicable law.

14. Suspension & Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for us, or as required by law. Sections that by their nature should survive termination — including content ownership, disclaimers, limitation of liability, indemnification, and governing law — will survive.

15. Changes to the Service & Terms

We may modify or discontinue features at any time. We may also update these Terms; for material changes we will update the "Last updated" date and provide reasonable notice (such as an in-app notice). Your continued use after changes take effect constitutes acceptance.

16. Governing Law & Disputes

These Terms are governed by the laws of [GOVERNING LAW / JURISDICTION], without regard to conflict-of-laws principles. Subject to applicable mandatory consumer protections, any disputes will be resolved in the courts located in [VENUE / CITY, COUNTRY].
